You authorize CCStorage LLC to facilitate recurring charges via ACH withdrawal from your bank accounts or charges from your specified debit or credit card to pay your monthly rent for storage space pursuant to your agreement with Creekside Storage and Rentals (the “Customer Agreement”). CCStorage LLC shall only have the obligation to facilitate fund transfers from Creekside Storage and Rentals to you and shall have no obligation to make payments on your behalf, and you shall have no recourse against CCStorage LLC for any failure to make rental payments.

You recognize that CCStorage LLC is only providing a mechanism by which you provide your rent for the use of storage space pursuant to the Customer Agreement. CCStorage LLC has no liability whatsoever to you with respect to the Customer Agreement. The Customer Agreement is strictly between you and Creekside Storage and Rentals, and CCStorage LLC has no rights, obligations or responsibilities with respect to such Customer Agreement.

You agree to indemnify and hold harmless CCStorage LLC, its employees, agents, owners, and contractors for any claims, damages, or losses, including but not limited to attorney’s fees, connected with or arising out of the Customer Agreement, any payment dispute you may have with Creekside Storage and Rentals, or anything having to do with your storage space..

CCSTORAGE LLC SHALL BEAR NO LIABILITY OR RESPONSIBILITY FOR ANY LOSSES OF ANY KIND THAT YOU MAY INCUR AS A RESULT OF ANY PAYMENTS MADE BY OR ON YOUR BEHALF AND YOU AGREE TO INDEMNIFY AND HOLD HARMLESS CCSTORAGE LLC FOR ANY IMPROPER BILLINGS YOU MAKE TO CREEKSIDE STORAGE AND RENTALS

You irrevocably agree that jurisdiction and venue with respect to any action against CCStorage LLC shall lie solely with the Court of Common Pleas of Blair County, Pennsylvania, and you expressly and specifically waive all objections to personal jurisdiction and venue. THE PARTIES EXPRESSLY WAIVE THEIR RIGHTS TO A TRIAL BY JURY AND AGREE AND CONSENT TO A TRIAL BY COURT. Any and all matters of dispute between the parties to this Agreement, whether arising from the Agreement itself or arising from alleged extra contractual factors prior to, during, or subsequent to the Agreement, including, without limitation, misrepresentation, negligence, or any alleged tort or violation of the Agreement, shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its choice of law provisions, regardless of the legal theory upon which such matter is asserted.

CCStorage LLC reserves the right to change these terms or terminate this program at any time by providing electronic notice thirty (30) days prior to the effective date of the change or termination.
